The U.S. Department of State (USDOS) announced updated guidance for new and renewal nonimmigrant visa (NIV) applications effective September 6, 2025:
- Visa Applications in Country of Nationality or Residence: You should apply for your nonimmigrant visa at the U.S. Embassy or Consulate in your country of nationality or residence. Per U.S. Department of State, you must be able to demonstrate proof of residence in the country where you apply (if applying based on residency).
- If Visa Application Services Are Not Available: If the U.S. does not provide routine visa services in your country, you must apply at the designated embassy/consulate (unless your legal residence is elsewhere).
I secured my nonimmigrant visa interview prior to September 6. Where should I apply for my new or renewal nonimmigrant visa?
- Pre-existing Visa Applications: Visa appointments scheduled prior to September 6, 2025 will generally not be cancelled. Contact the specific consulate where you will be applying for your visa for confirmation of your appointment at your current location and whether there are additional requirements. If the consulate actively contacts you to cancel your appointment, reschedule your appointment based on your country of residence or nationality.
- New or Renewal Visa Applications scheduled on or after September 6, 2025: You should apply for your new or renewal visa at the U.S. Embassy or Consulate in your country of nationality or legal residence.

- Delays: If allowable by the consulate, if you apply for a nonimmigrant visa outside of your country of nationality or residence on or after September 6, 2025, anticipate extended visa issuance wait times. While ISSO cannot anticipate potential wait times for nonresidents, we can share that it will be longer than the current visa wait times for residents. Please note UCSF’s guidance which limits work and payment outside the United States (policy owned by Human Resources).
- Fees: Visa fees will not be refunded or transferred, even if your application is refused or delayed.
- Check the official website of the U.S. Embassy or Consulate where you are a resident plan to apply for the latest rules, wait times, and procedures.
